REFUND POLICY

1. Return Policy

We accept returns. You can return unopened items in the original packaging within 30 days of your purchase with receipt or proof of purchase. If 30 days or more have passed since your purchase, we cannot offer you a refund or an exchange. Upon receipt of the returned item, we will fully examine it and notify you via email, within a reasonable period of time, whether you are entitled to a return. If you are entitled to a return, we will refund your purchase price and a credit will automatically be applied to your original method of payment.

Only regular priced items may be refunded. Sale items are non-refundable. Shipping and Handling Fees are also non refundable. To follow up on the status of your return, please contact us.

2. Exchanges

We only exchange goods if they are defective or damaged. In circumstances where you consider that a product is defective, you should promptly contact us with details of the product and the defect. You can send the item you consider defective to the return address we give you over the pone or e-mail. Upon receipt of the returned product, we will fully examine it and notify you via e-mail, within a reasonable period of time, whether you are entitled to a replacement as a result of the defect. If you are eligible, we will send you a replacement product.

To return the item you purchased, please contact us to obtain a return address. Refunds do not include any shipping and handling charges shown on the packaging slip or invoice. Shipping charges for all returns must be prepaid and insured by you. You are responsible for any loss or damage to hardware during shipment. We do not guarantee that we will receive your returned item. Shipping and handling charges are not refundable. Any amounts refunded will not include the cost of shipping.

SPECIFIC DISCLAIMERS AS TO ‘RESULTS CLAIMS IN SALES AND PROMOTIONAL MATERIALS OR PRODUCT

If claims about results from using Ketopia™ were made and considered by you, you understand and acknowledge that such claims may be true for the persons who made the claims, including claims made by Ketofanclub about its principals’ own experiences with Ketopia™. If you are purchasing and/or using Ketopia™ as a product that was promoted for a particular purpose and if the promotional materials make claims about the results from the use of this product, you hereby warrant and agree that there exists some probability that the product will not deliver those same results to any particular person and that the refund of the purchase price (subject to the return of the product to Ketofanclub as described herein) is the full remedy for anyone who feels that the product did not deliver the results claimed.

Where this disclaimer and claims made in sales and promotional materials describing details pertaining to Ketopia™ are in conflict, the Terms of Use and Purchase Agreement shall be controlling except, and unless, Ketofanclub deliberately misled you or if such construction would cause material inequity. The sole burden is exclusively upon you to substantiate any deliberate deception allegedly committed by Ketofanclub that, in specified ways, caused you to purchase Ketopia™ on one or more occasions. You accept the obligation to reimburse Ketofanclub for all court costs, investigation costs, attorney fees, and all litigation-related costs in the event you brings suit against Ketofanclub and you do not prevail in court or at arbitration.

No warranties are made whatsoever about the Ketopia™ product and you warrant that you have a clear understanding that your sole and only course of action is to test the Ketopia™ product within the extent of the refund period, and if you is not satisfied prior to expiration of the refund period set forth herein, then to properly request a refund from Ketofanclub in the manner set forth herein and subject to other relevant terms and conditions.

You, again, warrant that you have a clear understanding and agreement that in any event, for any reason, no matter the amount of damages claimed, as a material part of the consideration for purchase of this Ketopia™ product, the maximum amount of liability shall be the purchase price of the Ketopia™.

RIGHT TO STOP SELLING Ketopia™ TO CERTAIN PURCHASERS

You agree that Ketofanclub has the absolute and sole right to continue and/or discontinue the sale of the Ketopia™ at any time, for any reason, with or without notice, subject only to the return policy set forth herein.
